Terms of Service & Privacy Policy

These Terms of Service ("Terms") govern your use of the KULTURE mobile application and related services (collectively, the "Service") operated by Kulture Social, Inc. ("KULTURE," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms also incorporate our Privacy Policy, which describes how we collect and use your information. Both documents together form the full agreement between you and KULTURE.
1. Eligibility
You must meet all of the following requirements to use KULTURE:
You are at least 18 years old.
You are an individual (not a corporation, partnership, or other business entity).
You are legally able to enter into a binding contract.
You are not prohibited by law from using the Service.
You have not been convicted of, or pled no contest to, a crime involving violence, threats, or sexual misconduct.
You are not required to register as a sex offender in any jurisdiction.
You do not have an existing KULTURE account that has been suspended or terminated.
By using the Service, you represent and warrant that all of the above are true and remain true throughout your use. We reserve the right to terminate your account if any of these conditions are no longer met.
2. Your Account
You are responsible for your account and for keeping your login credentials secure. You may not share your account with anyone or create an account on behalf of another person. If you suspect unauthorized access to your account, contact us immediately at support@getkulture.co.
You agree to provide accurate, current, and complete information when registering. We may suspend or terminate accounts with inaccurate, misleading, or incomplete information.
3. Rules of Conduct
3a. You Agree To:
Use the Service in compliance with these Terms and all applicable laws.
Treat other users with respect, both on and off the platform.
Keep your profile honest and authentic, including using a photo that clearly shows your face.
Review and follow our Community Guidelines (available at getkulture.co/community-guidelines).
Take reasonable steps to protect the security of your account.
3b. You Agree Not To:
Misrepresent your identity, age, location, or any other personal information.
Harass, threaten, stalk, bully, or intimidate any other user.
Solicit money, gifts, or financial information from other users.
Post spam, chain messages, or unsolicited commercial content.
Use the Service for any illegal purpose, including fraud, money laundering, or trafficking.
Impersonate any person or entity, or falsely imply affiliation with KULTURE.
Scrape, mine, reverse-engineer, or otherwise attempt to extract data from the Service.
Upload viruses, malware, or any code designed to harm or disrupt the Service.
Create multiple accounts, especially if a previous account was suspended.
Attempt to probe or test the vulnerability of our systems.
Take screenshots of, copy, share, or otherwise distribute content from the app without prior consent.
Disclose the identity or personal information of any other user without their consent.
3c. Off-Platform Conduct
Your conduct outside of KULTURE — including in person, via text, on other platforms, or at events — may also result in action against your account. If we become aware of harm between users that occurred off-platform, or of relevant criminal or harmful conduct committed prior to or outside of your use of KULTURE, we reserve the right to take action, including suspension or termination, as if the conduct had occurred on the Service.
4. Content
4a. Your Content
You retain ownership of content you post on KULTURE ("Your Content"). By posting content, you grant Kulture Social, Inc. a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, and distribute Your Content solely to operate and improve the Service. This license ends when you delete the content or your account, subject to cached copies and operational requirements.
You represent that you own or have the right to post all content you submit, and that your content does not violate any third-party rights.
4b. Prohibited Content
You may not post content that:
Is sexually explicit, pornographic, or involves nudity in a sexual context.
Depicts or promotes violence, self-harm, or harm to others.
Is abusive, threatening, discriminatory, or hateful on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
Involves or exploits minors in any way.
Is defamatory, fraudulent, or knowingly false.
Infringes any copyright, trademark, or other intellectual property right.
Advertises products or services, solicits business, or involves commercial activity without our prior written consent.
Violates any applicable law or regulation.
We reserve the right to remove content that violates these rules without prior notice.
5. Events & In-Person Interactions
5a. KULTURE-Hosted Events
KULTURE produces, co-produces, and hosts in-person events ("KULTURE Events"). In connection with these events, KULTURE selects venues, curates the guest list, and manages partnerships. By registering for or attending a KULTURE Event, you acknowledge and agree to the following.
5b. Separate Event Waiver
Registration for each KULTURE Event requires you to review and accept a separate Event Liability Waiver at the time of signup. That waiver governs your participation in the specific event and is incorporated into these Terms by reference. In the event of any conflict between these Terms and an Event Liability Waiver, the Event Liability Waiver shall control with respect to the specific event. Your agreement to both this Section and the applicable Event Liability Waiver together constitute your full assumption of risk for participation in KULTURE Events.
5c. Assumption of Risk
Attendance at any KULTURE Event is entirely voluntary. By registering for or attending a KULTURE Event, you acknowledge that in-person social events carry inherent risks, including but not limited to risks arising from interactions with other attendees, venue conditions, physical activities, and the consumption of food or beverages. You voluntarily assume all such risks, whether known or unknown at the time of attendance.
5d. Venue & Third-Party Limitations
While KULTURE selects and partners with venues in connection with KULTURE Events, we do not own or operate the venues themselves. KULTURE is not responsible for the physical condition, safety infrastructure, staffing, or independent negligence of any venue or its operators. Any claims relating to the venue's premises, facilities, or independent conduct should be directed to the venue operator. KULTURE is also not responsible for the acts or omissions of third-party vendors, performers, caterers, or other service providers engaged in connection with any event.
5e. Guest Conduct at Events
KULTURE curates its guest list and reserves the right to deny entry or remove any attendee at its sole discretion. However, KULTURE DOES NOT GUARANTEE THE CONDUCT OF ANY ATTENDEE AND IS NOT RESPONSIBLE FOR THE BEHAVIOR, ACTIONS, OR OMISSIONS OF ANY INDIVIDUAL BEFORE, DURING, OR AFTER A KULTURE EVENT. YOUR INTERACTIONS WITH OTHER ATTENDEES ARE SOLELY YOUR OWN RESPONSIBILITY. KULTURE EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY INJURY, HARM, LOSS, OR DAMAGE — WHETHER PHYSICAL, EMOTIONAL, FINANCIAL, OR OTHERWISE — ARISING FROM THE CONDUCT OF OTHER ATTENDEES, EVEN AT KULTURE-HOSTED EVENTS.
KULTURE does not conduct criminal background checks on attendees and makes no representations about the character, background, or intentions of any individual admitted to an event.
5f. Informal In-Person Meetings
Users may also choose to meet informally outside of the KULTURE platform or KULTURE Events. IF YOU CHOOSE TO MEET ANOTHER USER OUTSIDE OF THE PLATFORM OR A KULTURE EVENT, YOU DO SO ENTIRELY AT YOUR OWN RISK. KULTURE EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY INJURY, HARM, LOSS, OR DAMAGE — WHETHER PHYSICAL, EMOTIONAL, FINANCIAL, OR OTHERWISE — ARISING FROM INFORMAL IN-PERSON MEETINGS OR INTERACTIONS BETWEEN USERS, EVEN IF THOSE USERS CONNECTED THROUGH THE SERVICE. We strongly encourage you to exercise caution, always meet in a public place, and tell someone where you are going.
5g. California Civil Code § 1542 Waiver
By using the Service and agreeing to these Terms, you expressly waive the benefits of California Civil Code Section 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." This waiver applies to all claims arising from your use of the Service, attendance at KULTURE Events, and interactions with other users, whether on or off the Service, known or unknown at the time of your agreement to these Terms.
6. Privacy & Data Collection
6a. What We Collect
We collect information you provide directly (name, phone number, photos, preferences, chat content), information collected automatically (IP address, device identifiers, location data while the app is active, usage activity), and information from third-party platforms if you connect social accounts.
Some information you may provide — such as your religion, ethnicity, or sexual orientation — may be considered sensitive in certain jurisdictions. By choosing to provide this information, you consent to our processing of it to operate the Service.
6b. How We Use It
We use your information to:
Operate, personalize, and improve the Service.
Communicate with you about your account, updates, and promotions.
Display relevant content and, where applicable, advertising.
Prevent fraud, ensure safety, and enforce these Terms.
Fulfill legal obligations and respond to law enforcement requests.
6c. How We Share It
We do not sell your personal information. We may share information with:
Service providers who perform functions on our behalf (hosting, analytics, payment processing, customer support) and are bound by confidentiality obligations.
Other users — your profile information is visible to other KULTURE users as part of normal app functionality.
Legal authorities when required by law, court order, or to protect rights and safety.
A successor entity in the event of a merger, acquisition, or sale of assets.
We may share de-identified, aggregated, or pseudonymized data with third parties for analytics and business purposes.
6d. Cross-Border Transfers
Your data may be processed and stored in the United States. If you access the Service from outside the U.S., you consent to the transfer of your information to the U.S. where our servers are located. We use appropriate safeguards for any international transfers.
6e. Data Retention
We retain your personal information while your account is active. If you delete your account, we will remove personally identifiable information from our records, unless retention is required or permitted by law. We may retain de-identified or aggregated data for analytics purposes.
6f. Cookies & Tracking
We use cookies, pixel tags, and mobile device identifiers to recognize you, personalize your experience, and measure Service performance. You can control cookies through your browser settings. Note that disabling cookies may affect certain features of the Service. We do not currently respond to "Do Not Track" signals.
6g. Your Rights & Choices
You can access, update, or request deletion of your personal information by contacting us at support@getkulture.co or through the Settings page in the app. California residents may also have additional rights under the California "Shine the Light" law (Cal. Civil Code § 1798.83). For questions about your privacy rights, please reach out to us directly.
6h. Children
The Service is for users 18 years of age and older. We do not knowingly collect personal information from anyone under 18. If we learn that a user is under 18, we will terminate the account and delete associated data.
7. Account Registration & Login
You register and log in to KULTURE using your phone number. We will send a one-time verification code to the number you provide to confirm your identity. You are responsible for ensuring your phone number is accurate and for maintaining access to it.
We may offer additional login options in the future. Any such additions will be reflected in an updated version of these Terms.
8. Intellectual Property
All content, design, software, and materials comprising the Service — excluding Your Content — are the property of Kulture Social, Inc. or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any of our content without prior written permission.
"KULTURE" and related logos and marks are trademarks of Kulture Social, Inc. Nothing in these Terms grants you a license to use our trademarks.
9. DMCA Copyright Policy
KULTURE respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA"). If you believe that content on the Service infringes your copyright, please submit a written DMCA Takedown Notice to our designated Copyright Agent that includes all of the following:
A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
Identification of the material claimed to be infringing, with information sufficient for us to locate it on the Service.
Your contact information, including address, telephone number, and email address.
A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability. If you are unsure whether material infringes your copyright, consult an attorney before submitting a notice.
10. Apple & Third-Party App Store Terms
If you download the KULTURE app from the Apple App Store or Google Play Store (each a "Third-Party Store"), the following additional terms apply. To the extent these Terms conflict with the applicable Third-Party Store terms, the more restrictive terms shall govern.
These Terms are concluded solely between you and Kulture Social, Inc., not with Apple Inc. or Google LLC ("Store Providers"). Kulture Social, Inc., not the Store Provider, is solely responsible for the app and its content.
The Store Provider has no obligation to provide any maintenance or support services for the app.
To the extent not effectively disclaimed, Kulture Social, Inc. — not the Store Provider — is solely responsible for any product warranties, whether express or implied by law.
Kulture Social, Inc. — not the Store Provider — is responsible for addressing any product liability claims, regulatory compliance claims, consumer protection claims, or intellectual property infringement claims relating to the app.
You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms with respect to Apple-enabled software. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.
11. Account Termination
You may delete your account at any time through the app Settings page. Upon deletion, we will remove your profile from public view; however, some data may be retained for a period of time as described in Section 6.
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms, poses a safety risk to any user, or that we otherwise deem inappropriate in our sole discretion. This includes conduct occurring off-platform, prior to registration, or outside the app. If we terminate your account, you will not be entitled to any refund.
Upon termination of your account for any reason, all provisions of these Terms that by their nature should survive will continue to apply, including without limitation the indemnification, disclaimers, limitation of liability, and arbitration provisions.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
No Guarantee of Results
KULTURE makes no guarantee that you will find a match, form a relationship, or achieve any particular outcome from using the Service. The Service is a tool to facilitate connections — what you do with those connections is entirely up to you.
User Content & Communications
KULTURE is a platform that enables users to communicate with one another. We are not the publisher or speaker of any user-generated content, including messages, profile information, photos, or any other content posted or transmitted by users. In accordance with Section 230 of the Communications Decency Act (47 U.S.C. § 230), Kulture Social, Inc. is not liable for any content created, posted, or transmitted by users of the Service.
We do not review, verify, or endorse any user content or communications. We reserve the right — but assume no obligation — to monitor, remove, or restrict content that violates these Terms or our Community Guidelines.
Force Majeure
Kulture Social, Inc. shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, government actions, internet or telecommunications failures, cyberattacks, or third-party service outages.
13. Indemnification
You agree to indemnify, defend, and hold harmless Kulture Social, Inc. and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
Your use of or access to the Service.
Your violation of these Terms.
Your violation of any applicable law or regulation.
Your Content, including any claim that your content infringes or violates the rights of any third party.
Your interactions with any other user, including any in-person meetings or events.
Any event you create, host, promote, or invite others to using the Service.
Any harm you cause to another user or third party in connection with your use of the Service.
We reserve the right to assume exclusive control of the defense of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of that claim. You may not settle any claim that imposes any obligation on Kulture Social, Inc. without our prior written consent.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KULTURE SOCIAL, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE — REGARDLESS OF WHETHER KULTURE SOCIAL, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID KULTURE IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). IF YOU HAVE NOT PAID ANY FEES, KULTURE'S TOTAL LIABILITY SHALL NOT EXCEED $100.
IF YOU ARE DISSATISFIED WITH THE SERVICE FOR ANY REASON, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING THE SERVICE AND DELETE YOUR ACCOUNT.
Some jurisdictions do not allow certain limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by applicable law.
15. Dispute Resolution
15a. Informal Resolution
Before filing any legal claim, you agree to contact us at support@getkulture.co and give us 30 days to attempt to resolve the dispute informally. Completing this step is a condition precedent to initiating arbitration.
15b. Binding Arbitration
If the dispute is not resolved informally, you and KULTURE agree to resolve any dispute, claim, or controversy arising from or relating to these Terms or the Service through binding individual arbitration, rather than in court, except for claims that qualify for small claims court.
Arbitration will be conducted by JAMS (or a mutually agreed arbitration service) under its applicable Consumer Arbitration Rules. The arbitration shall take place in New York, New York, or via video conference at the election of either party.
YOU AND KULTURE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR CLASS-WIDE ARBITRATION. THE ARBITRATOR MAY ONLY RESOLVE INDIVIDUAL CLAIMS AND MAY NOT CONSOLIDATE CLAIMS OF MORE THAN ONE PERSON.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
15c. Arbitration Opt-Out
If you are a new user, you may opt out of this arbitration agreement by sending written notice to support@getkulture.co within 31 days of first creating your account. Your notice must include your name, the phone number associated with your account, and an unequivocal statement that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms. If you do not opt out within this period, you will be bound by this arbitration agreement.
15d. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes not subject to arbitration under Section 15b shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
16. Third-Party Links & Services
The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of those third parties. Your interactions with third-party services are solely between you and those parties. Any reliance on third-party content is at your own risk.
17. Miscellaneous
Entire Agreement
These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and Kulture Social, Inc. regarding the Service and supersede all prior agreements, representations, or understandings between the parties.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. All remaining provisions shall continue in full force and effect.
Waiver
No failure or delay by Kulture Social, Inc. in exercising any right or provision under these Terms shall operate as a waiver of that right. A waiver of any particular breach or default does not constitute a waiver of any subsequent breach or default.
Assignment
These Terms, and any rights or licenses granted under them, may not be transferred or assigned by you without our prior written consent. Kulture Social, Inc. may assign these Terms, in whole or in part, without restriction and without notice to you. Any assignment in violation of this section is void.
Electronic Communications
By using the Service, you consent to receiving communications from us electronically, including via email, push notification, or in-app message. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
No Agency
Nothing in these Terms shall create or be deemed to create a partnership, joint venture, employment relationship, franchise, or agency between you and Kulture Social, Inc.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this document and may notify you by email or in-app notification for material changes. Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance. If you do not agree with updated Terms, please stop using the Service and delete your account.
